ACCEPTANCE OF TERMS:
Welcome to the online forums of the Columbia Marine Aquarium Club (CMAC). All marine aquarium enthusiasts from the novice who is just beginning to the tried and true expert are welcome to participate in our community and join CMAC.
The CMAC online forums provide a service to our members, subject to the following Rules of Conduct. These rules may be updated by the BOD from time to time without notice. Those found in violation of these rules are subject to disciplinary actions including written warnings, temporary suspensions, loss of club privileges, termination of website access and termination of membership in the CMAC. The CMAC Board of Directors (BOD) will determine the appropriate level of disciplinary on a case by case basis.



DESCRIPTION OF SERVICE:
CMAC, provides discussion and informational resources for our members centered around the marine aquarium hobby. But this is the internet. CMAC shall NOT be held liable to any person on account of that person?s use of the site or dependence on the site. To this extent, CMAC makes no warranties as to the accuracy of information contained on this web site or chat forums and can not screen or authenticate all articles, posts, listings or other information.


CONTENT:
Any and all content posted in publicly accessible areas of CMAC are the responsibility of the creator. CMAC makes no claims or warranties about such information or its authenticity. Upon posting any content on CMAC, you grant CMAC the right to publish, modify and use of such content.
The CMAC BOD will respond expeditiously to claims of intellectual property infringement. CMAC will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act ("DMCA"). This includes, but is not limited to, copyright and patent infringements. Should a violation of intellectual property be discovered, the document(s) or messages in such violation will be removed in a timely manner after any and all investigating has been completed to prove the authenticity of such a claim.

Users of the CMAC online forums agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial or noncommercial purposes any portion of the services or content contained within the CMAC website.

This Agreement shall be constructed and controlled by the laws of the State of South Carolina. Each Member and user agrees to personal jurisdiction by the state and federal courts of the State of South Carolina. The CMAC BOD reserves the right to change, modify or update this agreement at any time without notification. By accessing CMAC, users show their full agreement and acknowledgement of the restrictions, limitations and terms set forth in this agreement.



DISCUSSION BOARD RULES OF CONDUCT:
Keep it clean. Keep it civil. Keep it Reasonable. Keep it rational. This is a work-place friendly discussion board. While the BOD will do their best to keep it that way, it\\''s impossible for us to review every post. All posts do not necessarily reflect the views of CMAC and are the opinions of their respective authors. As such, CMAC is not responsible for the content, or accuracy of posts. If you feel a post violates any rules contained herein, or the post is inappropriate, inflammatory, crud or offensive, please use the report link at the bottom of the post to notify us.
Please note that we have prepared this document to help users understand what constitutes various types of prohibited content. This list is by no means all inclusive and ultimately issues will be addressed on a case-by-case basis. If you feel a post violates these rules directly or in spirit, you are asked to bring the post to the attention of a member of the BOD by clicking the "report this post" button at the end of any post.

In general, profanity, personal insults, discrimination, passive attacks, aberrant behaviors, posts with intent to flame a situation, libelous and otherwise offensive content is never allowed. Additionally, individuals organizing others to make posts for or against an argument in an attempt to sway opinion, attack another member or cause disruption of the board is not allowed and grounds for discipline of all participating members. Furthermore, while ?adult? subjects may occasionally be touched on, our intent is to ensure that any individual using CMAC in a work place environment can feel comfortable that no coworker, employee or boss would take offense to the content shown and that the content would not violate any law related to workplace harassment or discrimination.



Account Creation and Security
Administrators are the only users permitted to have multiple board identities for the sole purpose of testing and resolving technical issues. Each member is allowed to have one personal account only; creating multiple accounts on CMAC will not be tolerated and is grounds for suspension and possible termination of site privileges. While the same IP address may have multiple users, using multiple accounts as one in a disruptive manner or otherwise in violation of the intent of this rule or any other rules contained herein is grounds for suspension or termination of all users associated with that IP address and the IP address itself. Single IP addresses used by multiple users to violate these rules will also be suspended or terminated from using this service.
Members are responsible for all posts associated with their user name. To maintain the integrity of their account, members should never share their password with anyone, and post only from their registered account. Members sharing their account log in with someone not associated with their account are in violation of the rules and subject to having their forum privileges terminated. Likewise, IP addresses used to violate these rules will be blocked from using the CMAC forums.



Flaming
"Flaming" includes but is not limited to: Harassment, threats and personal insults: Posts that contain direct or indirect threats of a physical or non-physical nature along with posts that contain personal attacks or insults are not allowed. Users are also expressly forbidden from engaging in activities that may be seen as harassment. This includes targeting other users with a personal attack, intentionally responding to all of a particular user\\''s thread in a negative manner in order to discredit them or otherwise seeking to intentionally anger, upset or continuously attack another member (trolling). Constructive criticism of other members and debate is encouraged as long as it does not turn into a personal attack. In the event that either party feels a debate is no longer constructive, we ask both parties to respectfully disengage before creating a disruption of the thread. Members generally report flaming when dissenting members post highly insensitive reactions to an opinion on the board. Respectfully communicated opinions - in agreement or not - are welcome; "flaming" will not be tolerated.


Do Not Air Dirty Laundry
If you have a situation which is potentially embarassing, argumentative, demaning, of an aggravated nature, personal or otherwise best left private, guess what? KEEP IT PRIVATE. Use the PM function. Postings that are negatively directed toward specific individuals that are considered harassing or inappropriate are not allowed.


Trolling
"Trolling" is posting with the intent to create a dispute or disrupt the peace and harmony of a forum. It is the intent that causes this to be different than expressing a controversial or dissenting opinion. "Trolling" also occurs when members place inflammatory or outrageous remarks or statements in their profiles and signature lines that are designed to bait other members into a controversial or heated discussion. ?Trolling? is also orchestrating others to engage in posts in a negative way or to skew one opinion over another or for the purposes of promoting a personal agenda. "Trolling" will not be tolerated.


Discrimination
Topics targeting, exploiting, making fun of or otherwise baiting users into controversy based on race, color, ancestry, national origin, religion, marital status, disability, medical condition, age, sex, pregnancy, veteran status, sexual orientation or any other class protected by workplace laws are strictly prohibited.


Spamming
"Spamming" involves the creation or perpetuation of chain mail, cross-posting topics in multiple forums, and sending unwanted email or personal messages (PM\\''s) usually for the purposes of promoting a personal agenda. "Spamming" will not be tolerated.


Vulgarity and Offensive Posts
Language or material that, in context, depicts or describes sexual or excretory organs or activities is prohibited.


Keeping Threads on Topic
CMAC asks that members stay on topic. We understand that topics may evolve as they are discussed; therefore, when a thread wanders significantly off topic (as an example, several posts on an unrelated topic), the deviating posts may be split off and placed into a new thread. Persistent and intentional deviation in threads by any one member will not be tolerated.


Offensive Materials, Links or Images
CMAC recognizes that what offends one person may not offend another. There is not an exclusive list of offensive materials. Instead, we encourage members to use the "reasonable person" and "work friendly environment" standards.
Messages, images, photos, avatars, signature lines and personal websites space (offered to certain levels of membership on CMAC) that are, at the discretion of the BOD, inappropriate, obscene, vulgar, pornographic, sexually-explicit, hateful, threatening, racist, sexist, discriminatory, slanderous, defamatory or otherwise in violation of any local or international laws will not be tolerated. Additionally, links and bookmarks to other sites that contain these types of materials are not acceptable.

Decisions on whether behavior is or is not appropriate will be made by the CMAC BOD.



Sponsors and Advertising
CMAC, maintains relationships with numerous companies and sponsors which are unrelated to the membership of this board. For the purposes of brevity, we refer to Advertisers and Sponsors as one. Sponsors, and agents of sponsors (i.e. those representing sponsors, sponsor liaisons, those employed by sponsors or othewise representing the agenda of a sponsor) are NOT entitled to extra privileges nor may they break or disobey these rules in any way. Sponsors and agents of sponsors (formal or casual) may not engage in advertising activities or promotion of their businesses, agendas or business activities outside of their assigned sponsor forums. Sponsors, shall not engage in argumentative discussions with the membership or BOD of the CMAC. Sponsorship does not imply CMAC endorsement of a product, service or user. Please contact the BOD for further details. While a sponsor may respond to a request for information, they are expressly forbidden from starting posts about their goods or services outside of their assigned forums. Likewise, members may not start a post about a goods or services for a sponsor outside of that sponsors forum without the expressed consent of the BOD. A user may only include their company\\''s URL within their signature line. Additionally:
1. Sponsor forums are not a place to criticize, comment on or in other way speak to the reliability or history of another user\\''s advertisement. Messages commenting on the quality or value of a deal negatively are expressly forbidden as are messages that "flame", "troll" or otherwise negatively attack a company for their business practices.

2. Posting competing or counter offers to an advertisement in this forum is expressly forbidden.

3. It is the Sponsor\\''s responsibility to maintain the accuracy of the information posted regarding their particular product or service offered. CMAC is not responsible.

4. Sponsors are encouraged to participate in the board discussions. Their activities in the forums are obligated to the same rules as all other members and as specifically outlined above.



Materials with Copyright or Licensing Protection
Materials that are licensed or have a copyright may not be uploaded, attached, or posted on CMAC. For example, you may not post, upload, or attach full articles copied off of another website. Partial information and a link to the full article referenced are allowed, as long as it is not, in the sole discretion of the BOD, substantial.
When a user post or uploads unoriginal materials, they are indicating that they have the appropriate permissions from the source to do so, and the user posting the material indemnifies CMAC from any legal action related to the action. The user also accepts sole responsibility for any breach of copyright or licensing that occurs.



Disciplinary Actions
Under no circumstances will the CMAC BOD disclose reasons or rationale for any disciplinary action to a third party. We view this as a privacy issue and are committed to protect the privacy of the board\\''s users and club members at all times. While we do respect a user\\''s desire to request a review of the status of their account, we specifically forbid the use of sock puppets (multiple user accounts) or another user\\''s account to make your case. All such requests must be sent to the BOD for consideration. At this point of the process, we will not feel obliged to correspond any further unless we change your status.
We take these rules VERY seriously and hope that you will too! We do not tolerate disrespect of any kind at CMAC - particularly towards our BOD and/or management. We encourage the open exchange of thoughts, information, ideas and opinions as long as they remain respectful to the reasonable person.





Account Deletion
Member Class Accounts will be deleted if:
1. Registration process is not completed within three days.
2. No posts in forums in past 2 years.
3. Serious violations of code of conduct. (This applies to all classes of accounts)
